Abstract

تناولت هذه الدراسة تنظيم اللا مركزية الإدارية في قانون الهيئات المحلية في فلسطين، ولقد اعتمد الباحث في دراسته على المنهج التحليلي، والذي من خلاله تم استعراض النصوص التشريعية ذات الصلة بموضوع الدراسة وتحليلها مع الاستعانة بآراء الفقه في هذا الصدد. وقد طرحت هذه الدراسة إشكاليتها الرئيسة المتمثلة بمدى كفاية التنظيم القانوني للا مركزية الإدارية في قانون الهيئات المحلية رقم (1) لسنة 1997م وتعديلاته. ولقد قسم الباحث هذه الدراسة إلى ثلاثة فصول، الفصل الأول تناول فيه ماهية اللا مركزية الإدارية من خلال بيان مفهوم اللا مركزية الإدارية وتحديد أهميتها وصورها وخصائصها، بالإضافة إلى تمييزها عما يختلط بها من نظم مشابهة. أما الفصل الثاني فقد تناولنا فيه آلية تشكيل الهيئات المحلية من خلال التطرق إلى الانتخاب كوسيلة لاختيار أعضاء المجالس المحلية، فضلاً عن بيان التنظيم القانوني لمراحل انتخاب أعضاء المجالس المحلية، وكيفية ملء الشواغر، بالإضافة إلى تحديد اختصاصات الهيئات المحلية في كل من المجال التنفيذي والاقتصادي والاجتماعي والصحي. بينما جاء الفصل الثالث والأخير ليوضح ضوابط العلاقة بين الهيئات المحلية وجهة الوصاية المركزية، عبر التطرق إلى استقلال الهيئات المحلية عن الجهات المركزية، فضلاً عن بيان رقابة الوصاية المركزية على الهيئات المحلية. وانتهت الدراسة بخاتمة تضمنت مجموعة من النتائج والتوصيات المقترحة والتي من أبرزها: أن قانون الهيئات المحلية رقم (1) لعام 1997م وتعديلاته وقانون انتخاب مجالس الهيئات المحلية رقم (10) لسنة 2005م وتعديلاته، لم يشترطا حداً أدنى من المؤهل العلمي لمرشحي أعضاء المجالس المحلية. كما ويوصي الباحث بتعديل قانون الهيئات المحلية رقم (1) لعام 1997م وتعديلاته ، بإضافة المؤهل العلمي كأحد شروط مرشحي أعضاء المجالس المحلية . Abstract This study deals with the organization of administrative decentralization in the local authorities law in Palestine. In his study, the researcher relied on the analytical method, through which the legislative texts related to the subject of the study were reviewed and analyzed, with the help of the views of jurisprudence in this regard. This study has clarified the main problem represented in the adequacy of the legal regulation of administrative decentralization in the Local Authorities Law No. (1) of 1997 and its amendments. The researcher divided this study into three chapters: The first chapter dealt with what is meant by administrative decentralization by clarifying the concept of administrative decentralization and determining its importance, forms and characteristics, in addition to distinguishing it from other similar systems. As for the second chapter, the researcher dealt with the mechanism of forming local councils by addressing the election as a mean of selecting members of local councils, as well as he clarified the legal regulation of the stages of electing members of local councils, and how to fill vacancies, in addition to defining the competencies of local councils in the executive, economic, social and health fields. Finally, the third chapter defined the controls of the relationship between local authorities and the central guardianship destination, through the independence of local councils from the central authorities, as well as clarifying the central guardianship control over local councils. The study ended with a conclusion that included a set of results and suggested recommendations, the most important of which are: - The Local Authorities Law No. (1) of 1997 and its amendments, and the Local Councils Election Law No. (10) of 2005 and its amendments, did not require a minimum educational qualification for local council members' candidates. - The researcher also recommends amending the Local Bodies Law No. (1) of 1997 and its amendments, by adding an academic qualification as one of the conditions for candidates for members of local councils.
