Abstract

تناول الباحث موضوع أثر قرارات الأمم المتحدة بشأن حق تقرير المصير على ترسيم حدود الدولة الفلسطينية. وقد تمثلت مشكلة الدراسة في مدى تأثير قرارات الأمم المتحدة بشأن حق تقرير المصير على ترسيم حدود الدولة الفلسطينية. في حين هدفت الدراسة إلى بيان مدى توافق قرارات الأمم المتحدة مع القانون الدولي بشأن حق تقرير المصير على ترسيم حدود الدولة الفلسطينية. واستخدم الباحث المنهج الوصفي التحليلي، وذلك بتحليل قرارات الأمم المتحدة والمعاهدات الدولية والمواقف الرسمية للدول وأحكام القضاء الدولي وآراء فقهاء القانون الدولي المتعلقة بحق تقرير المصير، والربط بينها وبين ترسيم حدود الدولة الفلسطينية وفقاً لقرارات الأمم المتحدة. وقد قسّم الباحث الدراسة إلى فصلين، حيث تناول في الفصل الأول حق تقرير المصير في ظل قرارات الأمم المتحدة، بينما تناول في الفصل الثاني الطبيعة القانونية لترسيم حدود دولة فلسطين على الأراضي الفلسطينية. وقد خلص الباحث إلى مجموعة من النتائج والتوصيات، حيث كان من أهم النتائج التي توصل إليها الباحث أنه من حق الشعوب تقرير المصير والاستقلال عن الاستعمار وإقامة دولة ذات سيادة وهذا ثابت من قرارات الأمم المتحدة المتفقة مع أحكام القانون الدولي؛ إلا أن الاحتلال الإسرائيلي قد انتهك هذا الحق من خلال الاستيطان وإطالة أمد الاحتلال وبناء جدار الفصل العنصري وغير ذلك. بينما كانت أهم التوصيات: نوصي المجتمع الدولي ومجلس الأمن الدولي والأمم المتحدة بضرورة اتخاذ خطوات جادة وصارمة بحق "إسرائيل" لإلزامها بالإنسحاب من كل حدود فلسطين التاريخية، وإلزامها بالتقيد بقواعد القانون الدولي وقرارات الشرعية الدولية وإنهاء حالة الاحتلال اللاشرعي، ومساعدة الشعب الفلسطيني في تقرير مصيره وبناء الدولة الفلسطينية على حدودها التاريخية. Abstract The researcher dealt with the subject of the impact of United Nations resolutions on the right to self-determination on the demarcation of the borders of the Palestinian state. The problem of the study was the impact of United Nations resolutions on the right of self-determination on the demarcation of the borders of the Palestinian state. While the study aimed to show to extent, the United Nations resolutions are compatible with international law regarding the right of self-determination to delineate the borders of the Palestinian state. The researcher used the descriptive-analytical approach by analyzing United Nations resolutions, international treaties, official positions of states, international court rulings, and the opinions of jurists of international law related to the right of self-determination, and linking them to the demarcation of the borders of the Palestinian state in accordance with United Nations resolutions. The researcher divided the study into two chapters. In the first chapter, he dealt with the right to self-determination in light of United Nations resolutions, while in the second chapter he dealt with the legal nature of demarcating the borders of the State of Palestine on the Palestinian territories. The researcher concluded a set of results and recommendations. One of the most important results was that peoples have the right to self-determination, independence from colonialism, and the establishment of a sovereign state and this is consistent with United Nations resolutions in accordance with the provisions of international law. However, the Israeli occupation has violated this right through settlement, prolonging the occupation, building the apartheid wall, and so on. While the most important recommendations were: We recommend the international community, the UN Security Council and the United Nations to take serious and strict steps against "Israel" to compel it to withdraw from all Palestine's historic borders , and to oblige it to abide by the rules of international law and resolutions of international legitimacy, end the state of illegal occupation, and help the Palestinian people to decide their fate and build The Palestinian state on its historical borders.
