Abstract
The Palestinian Civil Service Law No. (4) of 1998 and its amendments regulated the provisions related to procedures, Employment in the public office and its control. This study discussed appointment in the public office, where the terms of appointment were studied through researching the general conditions for Employment such as nationality, age, health fitness, moral validity, and conditions Especially such as scientific and technical competence, performance of military service or exemption from it, loyalty and belonging to public office, and the study also dealt with methods of selecting public employees, such as the free and direct selection method, the method of election, and job competitions. The study also included a definition of the job status of the public employee, such as the period of experience, transfer, and assignment A secondment, terminus and termination of a public employee. For this reason, our study was based on recruitment in the public office and its control, and the researcher in this study followed the analytical method and divided this study into three chapters. In the first chapter we talked about: What is the public office and the public employee, and we explained the concept and what the public office is, then we talked about the concept The public employee, and then we discussed in the second chapter of them: the conditions and methods of appointment in the public office, and we talked during it about the conditions of appointment in the public office, then we discussed the methods of appointment in the public office and finally we moved in the third chapter to talk about: Judicial oversight of the conditions of appointment to the position In it we dealt with the nature of judicial oversight and its procedures, and then the conditions and procedures for appointment to the public office were challenged In conclusion, the researcher reached several results and recommendations, presented at the end of this study, where he reached the most important results, which in addition to personal conditions, there are objective conditions that must be met to assume a public position, and the Civil Service Law did not specify the maximum age for who would occupy a public position, and the most important recommendations It is the call of the Palestinian legislator to work towards achieving the principle of placing the appropriate employee in the appropriate job, so that the psychological stability of the employees is achieved, and the best use of their competence, experience and capabilities is made, and that there must be equality in assuming public jobs, between males and females, because women, especially at present, have proven their worth In public administration.
