Abstract

The importance of applying the concept of specialized justice to the regular Palestinian judiciary has emerged This is because the current era is marked Rapid development in all aspects of life, which in turn has been reflected in the diversity of crimes and conflicts, In addition progress and continued technological development have created transactions that did not already exist, The ensuing proliferation, diversity of cases and the complexity of the laws dealt with It requires it The preparation of judges to be made to the knowledge of their proceedings and their dispositions, hence the need to prepare the judge It looks only at issues that fall within its competence In courts dedicated to this, This will ensure justice and equality for all. The researcher has followed the analytical descriptive approach in this study Except for the requirement for the establishment of the regular judiciary based on the historical approach, the study is based on a description of the legal approach, reality and events, thus, the analysis, commentary and analysis of this reality and of those legal texts relating to the subject matter of the study; we have divided this study into four chapters, and the investigator in Chapter 1 examined the general framework of the study, as for the second chapter, the researcher mentioned the statement of the concept of justice Specialized and the nature of the Palestinian regular judiciary, the relationship between them, and the study methodology and procedures were addressed by the researcher in Chapter 3 Chapter 4 discussed analyzing data, testing and discussing study hypotheses, to the conclusion that included the findings and recommendations of the study. In conclusion, the researcher reached a series of conclusions, the most important of which was: The application of the concept of specialized justice become imperative to keep abreast of modern, economic and technological developments in all Aspects of life, the fact that the law and the judiciary are the most important pillars on which it is based All human requirements in all communities. The study recommended several recommendations, including: Let the Supreme Council of the Judiciary apply the concept of specialized justice, through the formation of specialized courts in which specialized judges work, as well as the recommendation on the importance of Focus on the numbers of judges who specialize in all that is required Legal knowledge and scientific formation Specialization leads to efficiency and work.
