Abstract

The study investigated the concept of state administration, using idealist and realistic schools, and it had been evaluated in the light of the Islamic legal policy (Sharia). The problem of this study emerged from its try to identify the administration of each school to know the extent of their agreement with the Islamic legal policy. This study asked mainly: what is the nature of running the state using ideal and realist schools in the light of the Islamic legal policy? This study aimed to identify the nature of the practices of the two schools and determine the extent of their agreement with the Islamic legal policy. The importance of this study stems from showing the subject of running the state through idealist and realistic schools according to the Islamic legal policy, especially after the big failure which hit the Arab Spring Revolutions which their leaders thought that the Authoritarian regimes which controlled their countries can go away easily but soon this was proven wrong as these regimes were able rebirth again. The limitation of this study was represented in studying the samples of s of some rulers' practices in both schools and their evolution in the light of the Islamic legal policy. This study used mainly the descriptive analytical method as it considered a wide and flexible umbrella which includes a number of methods and sub methods. The results of this study indicated that: the Islamic legal policy includes highly qualified system for good governing. The Islamic legal policy represents a virtual realistic school and forms a civil state with Islamic background. Rulers who tend to use excessive idealism in running the country without looking at the real needs cannot stay long in the regime. Rulers who tend to realism with the Islamic legal policy conditions can keep their state, control their people and rebels. For recommendations: It's necessary for Islamic and Arab rulers and their assistants to know the rules of Islamic legal policy, jurisprudence purposes and reality. Reviewing of the current governing policies in countries and updated them according to bases of the Islamic legal policy reinforcement of the Islamic culture among people especially those parts which related with policy, governing and state administration. Allowing political objection to take its role and practicing the political objection within the national dialogue upon the Islamic believes and values.
