Abstract

The palestinian water resources have long been a subject for Israeli violations, those violations were never given proper attention from the Palestinian politicians in general, and from the negotiators in particular, that is tantamount to the importance they deserve for the Palestinians as an essential substance for their life and for the vital role in the creation and development of the Palestinian entity, this study is trying to shed some light on the political and legal dimensions of these violations. The study were divided into the theoretical framework and four chapters , after reviewing the importance of the study , its questions and the research methodology that has been followed , the preliminary chapter was dedicated for water resources in historical Palestine , before the announcement of the Zionist entity, were the surface water like Jordan river ,Tiberias lake as natural reservoir of Palestine , the wadis in the west bank and also the Wadi Gaza ,Salqa and Bait Hanoun wadis in Gaza strip, the ground water resources were reviewed, the mountain aquifer beneath the west bank comprising three sub aquifers the western, the eastern and the north eastern one , the Carmel aquifer in Haifa area ,also the coastal aquifer which includes also Gaza strip aquifer.In the first chapter the researcher has gone through the Israeli violations of the Palestinian water resources through the diversion of Jordan river water course ,also the exploitation of the water aquifers to the maximum limit and at the same time depriving the Palestinians by military force from utilizing their water. In the second chapter the study tackled the political dimension of the Israeli violations of the Palestinian water rights from two aspects, the first one is pinpointing the central role the water in the establishment ,the development and ح Abstract sustainability of the entity through bringing more settlers that entails extra quantities of water that planned to be taken from the Palestinian water, and the other aspect is to lessen the quantities of water available to the Palestinians in an endeavor to prevent or hampering establishment of Palestinian entity. In the third chapter the legal dimensions of the Israeli violations of the Palestinian water resources were reviewed through mentioning the international agreements that regulates the shared water resources, also the Palestinian negotiation experience in the water sector and its shortcomings was reviewed, the Israeli negotiating tactics and the necessity that greater importance should be given to the water issue. The water rights were determined with greater clarity and the violations of water resources also , the little importance attached to the water issue by the Palestinian politicians were pointed at, also the Israeli negotiating tactics were articulated and the loopholes in the international law through which the Israelis tried to justify their illegal control of the Palestinian waters , the researcher recommend to give more attention to the legal aspects of the water issue and, having good knowledge of the international water laws that help the Palestinians protect their rights ,giving the water issue the importance it deserves in the Palestinian political agenda ,development of negotiating strategy that includes training negotiating personnel capable of dealing with the Zionist entity in the language which he understands and on modern basis with complete understanding of political and legal aspects of the water issue.
