Abstract
The purpose of this research is to study the Palestinian diplomatic representation in the light of conflict of Palestinian state recognition and Palestinian Liberation Organization. The Palestinian Liberation Organization (PLO), had diplomatic representation in a number of Arab and foreign countries, as well as at the United Nations (UN) as a permanent observer, and since November 29, 2012, the representation of Palestine was given a new title as a non-member observer state. The study explores the future of the Palestinian diplomatic representation, the origin of this representation, its evolution and development, and the way this representation has been in accordance with diplomatic laws and traditions. It also studies the impact of accepting Palestine as a non-member observer state on the country’s diplomatic representation and the impact of the Palestinian division on such representation. The author had adopted the descriptive analysis and institutional descriptive analysis method which relies on collecting data, analyzing and explaining it. Furthermore, the study includes interviews conducted with experts, researchers and academics in this field. The study is consisted of five chapters in which the first one represents the general background of the research including: (the introduction, problem statements, the questions, the significance, the objectives and the limits. Moreover, the previous studies and the main important concepts had been entailed. The second chapter which represented in the theatrical framework had encountered the diplomacy and the diplomatic representation. Here, the researcher provokes the development phases of diplomacy figured in its types and instruments in addition to entailing diplomacy by its conditions, diplomatic delegations and the liberal movements roles in the diplomatic action. The third chapter had encountered the development had encountered the development of Palestinian diplomatic representation throughout the pre-establishing of PLO and the phase of establishment. Furthermore, this chapter had clarified the acted role of Palestinian diplomacy in covering out the political legacy of PLO. In the following chapter, the researcher had studied the Palestinian diplomatic role of Palestinian issue (1993-2007). In this fold, this study had explored the diplomatic role of Palestinian Authority, the specialist affiliation of diplomatic representation and the reaction of political rift on the Palestinian diplomacy and the national project. In the final chapter, the study had represented Palestinian state recognition and the future of PLO. The study has resulted in a number of findings which include the following: Palestine is considered a member of the international diplomatic law, which is considered a branch of the general international law represented by PLO which based on the recognition of liberation movements as a member of the general or broad international law. Palestinian division has had a negative impact on the broader Palestinian national cause in general and on the Palestinian diplomacy, in particular. The division represented the Palestinian people as ones with divided goals and principles. The success of Palestinian diplomacy in gaining a two-third majority decision from the United Nations General Assembly (UNGA), recognizing Palestine خ Abstract as a non-member state on November 29, 2012, and standing by it, makes the future of this decision seem the same as those other tens that remained non-binding and ineffectual. Based on these findings, the author recommends the following: Recognizing the PLO as the collective institution that represents all sectors of the Palestinian society, and affirming that the Political office within the PLO is in sole charge of representing the Palestinian people abroad, based on the condition that the organization itself be democratized and reconstructed based on national principles.Utilizing the recent Palestinian reconciliation in demonstrating that the Palestinian people and their political system and institutions are in fact united on principles and goals. Furthermore, it is recommended to work on enforcing all political and diplomatic achievements on all levels, in order to limit the occupation’s success in using the Palestinian division to weaken the Palestinians’ position politically, diplomatically and also on the negotiations table. So to Increasing the diplomatic efforts exerted with those various states that voted in favor of recognizing Palestine as a state in order to upgrade the Palestinian diplomatic representation in their respective countries to embassies, and ensuring that their recognition takes a more practical dimension. Furthermore, the diplomatic struggle within the UN should continue further by attempting to obtain full membership from the United Nations Security Council (UNSC). Using Palestine’s new designated status within the international community to pursue justice against the Zionist war crimes and human rights violations committed against the Palestinian people, in accordance with legal and strategic policies.
