Abstract

The study sought to identify the role of the judiciary in promoting good governance in Palestine, Whatever the accuracy in formulating the laws, it cannot achieve justice, and will not achieve it until they apply a fair and independent Jurisdiction , based on the principles of good governance, , And the independence of the judiciary. The subject of good governance has a great importance at the global level, and we can find this good governance only through the elimination in doing its primary role in the control to promote the concepts of good governance in any society. The study was based on the descriptive analytical method, and the researcher used the questionnaire as a method to survey 225 persons from Gaza Strip. 10 of whom are advisers in the Supreme Court and Court of Appeal, 23 judge are from the courts of first instance and the Magistrates, and 97 lawyers, 14 director and 40 are staff members in the judiciary, and 41 members in the behalf. Also the Researcher used the statistical SPSS program to analysis the questionnaire. The study concluded that there is a positive correlation between the level of application of the principles of litigation and the level of good governance in the judiciary. The study indicated that there are statistically significant differences due to the variable in job title in the estimates of the respondents about the level of application of the principles of litigation and the level of good governance in the judiciary. ط The study also showed that there is an urgent need to strengthen the legal and culture knowledge among decision makers and the heads of the legislature and the executive with the role of the judiciary in establishing rules of justice and the principle of the rule of law. Moreover, the development of infrastructure for all the courts in the Gaza Strip and the provision of appropriate facilities for the courts to achieve a fair judgment. In order to promote the role of the judiciary in supporting the foundations of good governance, the government should play a major role in the community to uphold the principle of the rule of law, and to strengthen the relationship between judges and lawyers and activate the system of specialization for judges in courts like some Arab and foreign countries that operate this system.
