Abstract

لا شك أن البحث عن المسؤولية الجنائيّة الدوليّة للاحتلال الإسرائيلي عن مسيرات العودة، في ظل تزايد اهتمام القضاء الفلسطيني، ومطالبته بإعطائه صلاحية النظر في هذه الجرائم؛ لمحاكمة مرتكبيها، والحكم بتعويض الضحايا وذويهم عن الضرر الذي أصابهم. خاصة في ظل استمرار تعطيل حق الضحايا الفلسطينيين في الحصول على إنصاف قضائي فعال على المستويين الإقليمي والدولي. لأجل ذلك أسست دراستنا على المسؤولية الجنائيّة الدوليّة للاحتلال الإسرائيلي عن مسيرات العودة. فقد اتبعت الباحثة في هذه الدراسة المنهج التحليلي، وقمنا بتقسيم هذه الدراسة إلى ثلاثة فصول تحدثنا في الفصل الأول عن: الحماية الجنائية الدولية للمدنيين. وقد بيّنا من خلاله ماهية المدنيين في القانون الدولي الإنساني.، ثم تحدثنا عن الحماية القانونية للمدنيين في مسيرات العودة.، ومن ثم تناولنا في الفصل الثاني منها: مسؤولية الاحتلال الإسرائيلي عن انتهاك حقوق المدنيين في مسيرات العودة ، وقد تحدثنا خلاله ماهية المسؤولية الجنائية الدولية، ثم تناولنا المسؤولية الجنائية الدولية للأشخاص والدول، وقد انتقلنا في الفصل الثالث للحديث عن: اختصاص المحكمة الجنائية الدولية بملاحقة جرائم الاحتلال في مسيرات العودة، حيث تناولنا فيه قواعد الاختصاص بنظر الدعوى ضد الاحتلال عن مسيرات العودة ، ومن ثم الصعوبات التي تواجه فلسطين في ملاحقة (إسرائيل) أمام المحكمة الجنائية الدولية، وختاماً توصلت الباحثة إلى عدة نتائج وتوصيات، أما النتائج فأبرزها أن يهتم القانون الدولي الإنساني بحماية المدنيين تحت الاحتلال إبان النزاعات المسلحة الدولية وغير الدولية؛ من خلال تقييد وسائل القتال وأساليبه؛ بحيث لا تتجاوز الضرورة العسكرية، وأما أهم التوصيات فكانت الانتهاء من الانقسام الفلسطيني، والتوافق فلسطينياً على تجديد شرعية مؤسساتهم السياسية من خلال صندوق الانتخابات؛ من أجل تجاوز مرحلة في غاية الصعوبة في التاريخ الفلسطيني الحديث. Abstract The search for international criminal responsibility for the Israeli occupation for return marches is undoubtedly a matter of increasing interest and demand that the Palestinian judiciary consider these crimes to try their perpetrators and to compensate the victims and their relatives for the damage they suffered. Especially in light of the continuous suspension of the Palestinian victims' right to effective judicial redress on the regional and international levels. For this purpose, our study was based on the international criminal responsibility of the Israeli occupation for the return marches. In this study, the researcher followed the analytical approach and divided this study into three chapters that we discussed in chapter I on international criminal protection of civilians We have also discussed the legal protection of civilians in the return marches, and we have therefore dealt with in chapter II of the International occupation's responsibility for violating the rights of civilians in the return marches. We spoke about what international criminal responsibility is, and then we addressed the international criminal responsibility of persons and States, and we moved in Chapter III to talk about: The International Criminal Court has jurisdiction to prosecute the crimes of occupation in the return marches, where the rules of competence deal with the case against the occupation of the return marches, and thus the difficulties that Palestine faces in pursuing (Israel) before the International Criminal Court In conclusion, the researcher reached several conclusions and recommendations, where she reached the most important findings and that international humanitarian law is concerned with protecting civilians under occupation during international and non-international armed conflicts by restricting the means and methods of fighting to military necessity, and the most important recommendations are ending the Palestinian division. The Palestinian agreement to renew the legitimacy of their political institutions through the election fund, in order to overcome a very difficult stage in the modern Palestinian history.
