Abstract

تهدف هذه الدراسة إلى تقديم دراسة قانونية موضوعية حول إفشاء الأسرار العسكرية من قبل الموظف العام العسكري وأثرها على وظيفته في التشريع الفلسطيني، وتبرز الأهمية العملية هو من المواضيع الهامة في حفظ أمن البلاد كما وأن الفقه الفلسطيني لم يقم بتناول الموضوع بشكل مفصل وفقاً لأهميته، وتكمن الأهمية العلمية في دراسة وتحليل وعرض أهم الجرائم التي تواجه المجتمع الفلسطيني لخطورتها بغية الوقوف على مواطن القصور والنقص في التشريع الفلسطيني ووضع رؤية واضحة وغير غامضة لتلافي القصور والنقص في التشريع ويتمثل السؤال الرئيسي في ما مدى تنظيم المشرع الفلسطيني لمسألة إفشاء الأسرار العسكرية من الموظف العام العسكري وأثرها على وظيفته في التشريع الفلسطيني؟ وللإجابة على هذا التساؤل تم استخدام المنهج الوصفي التحليلي. ولتحقيق أهداف هذه الدراسة تم تقسيمها إلى فصلين في الأول ماهية جريمة إفشاء الأسرار العسكرية وتناولنا خلاله مفهوم الموظف العام العسكري وواجباته والمحظورات عليه وكذلك تعريف جريمة إفشاء الأسرار العسكرية وأركان هذه الجريمة، ومن ثم انتقلنا إلى الفصل الثاني وتناولنا خلاله أثر العقوبة التي تصدرها الجهة المختصة بمحاكمة مرتكبي جريمة إفشاء الأسرار العسكرية، وتناولنا خلاله القضاء العسكري واختصاصاته، والأثر الوظيفي للعقوبة الواقعة على مرتكب هذه الجريمة، وفي النهاية توصل الباحث إلى عدة نتائج وكان أهمها يوقع على الموظف العام العسكري عقوبات عامة وهي تلك العقوبات الموجودة في القوانين العقابية وعقوبات خاصة وهي العقوبات الأصلية وهي تلك المنصوص عليها في قانون القضاء العسكري إضافةً إلى العقوبات التبعية، وإلى عدة توصيات وكان أهمها نوصي المشرع بضرورة تعديل قانون القضاء العسكري حيث توجد العديد من الجرائم التي يعاقب عليها القانون بالإعدام، وهي ليست كذلك في الأصل. Abstract This study aims to provide an objective legal study on the disclosure of military secrets by the military public servant and its impact on his job in the Palestinian legislation. Scientific importance in studying, analyzing and presenting the most serious crimes facing the Palestinian society in order to identify the deficiencies and deficiencies in the Palestinian legislation and develop a clear and unambiguous vision to avoid deficiencies and deficiencies in the legislation. On his job in the Palestinian legislation? To answer this question, the descriptive analytical approach was used. In order to achieve the objectives of this study, it was divided into two chapters. In the first, what is the crime of disclosing military secrets, we dealt with the concept of the military public servant, his duties and prohibitions on him, as well as the definition of the crime of disclosing military secrets and the elements of this crime. The crime of divulging military secrets, during which we dealt with the military judiciary and its specializations, and the functional impact of the punishment imposed on the perpetrator of this crime. In the end, the researcher reached several results, the most important of which is that the military public servant is subject to general penalties, which are the penalties found in punitive laws, and special penalties, which are the original penalties, which are those stipulated in the Code of Military Justice in addition to the ancillary penalties, And to several recommendations, the most important of which was we recommend to the legislator the necessity of amending the Military Justice Law, as there are many crimes that are punishable by the law with the death penalty, which is not the case in the first place
