Abstract

تناولت هذه الدراسةُ أحكامَ" الحمايةِ الجنائيةِ للموظفِ العام من جرائمِ التعدِّي اللَّفظي". وتعتبرُ أكثرَ الجرائمِ إنتشاراً بحقِّ الموظفِ العام، هي الجرائم اللفظية ؛لأنَّها لا تحتاجُ إلى تخطيطٍ معقدٍ وإنما يكفي لقيامها قول الجاني كلماتٍ تسيئُ إلى الموظَّف بقصد، وجاءت هذه الدراسةُ لتساهم في حل الإشكاليةَ الآتية" انتشار حالاتِ الاعتداءِ على الموظَّفِ العامِّ في السنواتِ الأخيرةِ بالإهانةِ اللفظيةِ والذمِ والقدحِ والقصورِ التشريعيِّ الحاصلِ في هذا الموضوعِ، وفي سبيلِ ذلكَ اتَّبع الباحثُ المنهجَ التحليلي المقارِنُ للنصوصِ المتعلقةِ بالموضوعِ في الدّولِ محل المقارنةِ وأيضا الأحكامُ القضائيةُ والآراءُ الفقهيةُ، وقد تناولَ الباحثُ في الفصلِ التمهيدي "ماهيَّةَ الموظفِ العامِّ باعتباره مّحَلِّ الحمايةِ الجنائية". ثم في الفصلِ الأولِ من هذه الدراسةِ ركَّزنا على "آلياتِ الحمايةِ الجنائيةِ من جرائم التعدي على الموظفِ العام" وفي الفصل الثاني أوضحنا" الضماناتِ التشريعيةِ للموظفِ العامِّ من جرائمِ التَّعدي اللفظي" ثم أوردنا في الخاتمةِ مجموعةً من النتائجِ وحُزمةً من التوصياتِ التي توصَّلنا لها من خلالِ هذه الدراسةِ وكانت أهمُّ نتيجةٍ توصَّلنا لها، أنَّ الفقهاءَ لم يتبنوا رأيًا واحدًا في الذهابِ إلى فكرةِ إحاطةِ الموظفين العموميين بإضافةِ حمايةٍ جنائيةٍ تُميُّزهم عن غيرِهم من النَّاس، باعتباره ظرفًاً مشددًاً للعقوبة كمجني عليه وكانت أهم توصيةٍ ضمنَ هذه الرسالة هي عدمُ الأخذِ بطبيعةِ الوسيلةِ لإقرار جريمة القدحِ والذّم ،وإنما من الأفضلِ الأخذُ بمبدأِ ذاتيةِ السلوكِ فهو يتفقُ مع مبادئِ السياسةِ الجنائيةِ. Abstract This study dealt with the provisions of "criminal protection for public servants from verbal abuse crimes" The most widespread crimes against the public employee are verbal crimes because they do not need complex planning and are sufficient for the offender to say words that offend the employee with intent. This study came to solve the following problem: "The prevalence of cases of assault on public servants in recent years by verbal insult, slander, defamation, and legislative shortcomings in this subject. For this purpose, the researcher followed the comparative analytical approach of texts related to the subject in the countries under comparison, as well as judicial rulings and jurisprudential opinions. In the introductory chapter, the researcher dealt with "what is the public employee as the object of criminal protection," and then in the first chapter of this study, we focused on "criminal protection mechanisms from crimes of assault on the public employee." In the second chapter, we explained the "legislative guarantees for public servants from crimes of verbal encroachment." Then, in the conclusion, we presented a set of results and a set of recommendations that we reached through this study, and the most important result we reached was: The jurists have one opinion in going to the idea of surrounding public officials by adding criminal protection that distinguishes them from other people as an aggravating circumstance for the punishment as a victim. As an aggravating circumstance for the punishment as a victim, the most important recommendation within this thesis is not to take into account the nature of the means to approve the crime of slander and defamation, but it is better to adopt the principle of self-behavior, as it is consistent with the principles of criminal policy.
