Abstract

تعتبر المعاهدات الدولية أحد أبرز المصادر الأساسية للقانون الدولي، والتي تنظم العلاقة بين أشخاص القانون الدولي، وتهدف الدراسة بشكل رئيس لتحديد آليات إنفاذ المعاهدات الدولية داخل التشريعات الوطنية، وتكمن مشكلة الدراسة في تعدد آليات إنفاذ المعاهدات الدولية في التشريعات المُقارنة، بينما القانون الفلسطيني لم يُحدد آلية معينة لإنفاذ المعاهدات الدولية داخل الأراضي الفلسطينية، ولا يوجد قانون يُنظم الأحكام الإجرائية والموضوعية للمعاهدات الدولية، وتبرز أهمية الدراسة في ظل حصول فلسطين على صفة دولة مراقب في الأمم المتحدة وانضمام فلسطين للعديد من المعاهدات الدولية وهو ما يوجب على فلسطين إنفاذ وتنفيذ هذه المعاهدات في تشريعاتها الوطنية، بينما اعتمد الباحث في هذه الدراسة على المنهج التحليلي والمنهج المُقارن من خلال القيام بتحليل النصوص القانونية والأحكام القضائية في فلسطين، وكذلك أحكام وقواعد المعاهدات الدولية، ومقارنة ذلك بالتشريعات المُقارنة الأخرى، كما وتوصل الباحث إلى العديد من النتائج أهمها أن القانون الفلسطيني لم ينص على آلية إنفاذ المعاهدات الدولية في التشريع الوطني وأيضاً دساتير التشريعات المُقارنة أخذت بطريقة الاندماج التلقائي وغير تلقائي في دمجها للمعاهدات الدولية داخل دساتيرها الداخلية، بينما توصل الباحث إلى العديد من التوصيات من أهمها نوصي المشرع الفلسطيني القيام بإصدار قانون موحد وطني ينظم الأحكام الإجرائية والموضوعية للمعاهدات في القانون الفلسطيني، بما فيها آلية إنفاذ المعاهدات الدولية في التشريع الوطني، كما نوصي رئيس السلطة القيام بتوزيع الاختصاصات ما بين السلطة التنفيذية والتشريعية المخول لها القيام بعملية التوقيع والتصديق على المعاهدات الدولية وتعزيز الرقابة البرلمانية والقضائية على المعاهدات الدولية في فلسطين. Abstract International treaties are one of the main sources of international law, which regulate the relationship between people of international law. The study aims mainly to define the mechanisms of harmonization of international treaties within national legislation. The problem of the study lies in the multiplicity of mechanisms for the harmonization of international treaties in comparative legislation, while the Palestinian law does not specify a specific mechanism for the harmonization of international treaties within the Palestinian territories, and there is no law that regulates the procedural and substantive provisions of international treaties. The study is important in light of Palestine obtaining the status of an observer state in the United Nations and Palestine's accession to many international treaties, which requires Palestine to harmonize and implement these treaties in its national legislation. The researcher relied in this study on the comparative analytical approach by analyzing legal texts and rulings, judicial rulings in Palestine, as well as the provisions and rules of international treaties, and comparing that with other comparative legislation. The researcher reached several results, the most important of which is that the Palestinian law does not provide a mechanism of harmonization of international treaties in the national legislation. Another result is that the constitutions of comparative legislation took the method of automatic and non-automatic integration in their integration of treaties into their internal legislation. The researcher reached several recommendations, the most important of which is that the Palestinian legislator shall issue a unified national law that regulates the procedural and substantive provisions of treaties in Palestinian law, including the mechanism for harmonizing international treaties in national legislation. The study recommends that the President of the Authority grant power to executive and legislative powers that are authorized to carry out the ratification process immediately and to sign international treaties and strengthen parliamentary and judicial supervision of international treaties in Palestine.
