Abstract

هدفت هذه الدراسة إلى بيان المسؤولية المتربة على تجاوز مأموري الضبط القضائي لصلاحياتهم، وبيان النتائج المترتبة عليها نظراً لخطورة الأعمال التي يقوم بها مأمورو الضبط القضائي أثناء أداء مهامهم الوظيفية بهدف تطبيق القانون وكفالة حقوق وحريات الأفراد، حيث إن مأموري الضبط القضائي قد يتجاوزن هذه الصلاحيات المخولة لهم قانوناً، ومن أجل ذلك فإنه يتوجب دراسة هذه الصلاحيات وبيان هذه الصلاحيات بالتفصيل، وبيان الجزاءات التأديبية والجزائية والمدنية المترتبة على تجاوز مأموري الضبط القضائي لصلاحياتهم المخولة لهم قانوناً. وقد اتبع الباحث في هذه الدراسة المنهج الوصفي التحليلي من خلال دراسة النصوص القانونية المتعلقة بجمع الاستدلالات والتحقيق وتحليلها من أجل الوصول إلى الإجراءات والضمانات التي تكفلها هذه النصوص، والتي يجب مراعاتها لتجنب عدم صحة الإجراءات المتبعة في مراحل الدعوى الجزائية في قانون الإجراءات الجزائية الفلسطيني رقم (3) لسنة 2001م. ثم توصل الباحث إلى العديد من النتائج ثم أتبعها بمجموعة من التوصيات، ومن أهم هذه النتائج: أن الجزاءات التأديبية والجنائية والمدنية التي نص عليها المشرع الفلسطيني جاءت كافية لردعهم ومنعهم من مخالفة الصلاحيات المخولة لهم قانوناً، وهي تمثل صمام الأمان لحماية الحقوق والمصالح العامة التي يسعى المشرع الفلسطيني للحفاظ عليها من خلال هذه الجزاءات، فضلاً عن ترتيب البطلان المطلق على مخالفاتها وانعدام أي أثر قانوني لهذه المخالفات غير المشروعة التي يرتكبها مأمورو الضبط القضائي بمناسبة مباشرتهم لأعمالهم. أما أهم التوصيات التي أوصى بها الباحث المشرع الفلسطيني وهي: ضرورة وضع تشريعات توضح لمأموري الضبط القضائي مختلف القضايا المتعلق بوظيفتهم، وتوضيح الصلاحيات المخولة لهم قانوناً. ABSTRACT This study aimed to clarify the dusty responsibility for the judicial officers to exceed their powers and to explain the consequences thereof. Given the seriousness of the work carried out by the judicial officers during the performance of their job duties with the aim of applying the law and ensuring the rights and freedoms of individuals, the judicial police may exceed these powers that are legally entrusted to them. Which entails a statement of these powers and a statement of disciplinary, penal and civil penalties for the judicial police officers to exceed their powers authorized by law and to clarify these powers and penalties that may be inflicted on them. In this study, the researcher followed the descriptive analytical approach by studying the legal texts related to the collection of inferences, investigation and analysis in order to reach the procedures and guarantees guaranteed by these texts, which must be taken into account to avoid the incorrectness of the procedures followed in the stages of the criminal lawsuit Then the researcher reached many results and then followed them with a set of recommendations, the most important of these results is that the disciplinary, criminal and civil penalties stipulated by the Palestinian legislator were sufficient to deter them and prevent them from violating the powers granted to them by law, and it represents the safety valve to protect the rights and public interests that the Palestinian legislator seeks Preserving it through these penalties, as well as arranging the absolute nullity of its violations and the absence of any legal effect for these illegal violations committed by the judicial control officers on the occasion of their performance of their work. Issues related to their job and clarify the powers conferred upon them by law.
