Abstract

إن الحق في الخصوصية بشكل عام لقي اهتماماً كبيراً منذ زمن من فقهاء القانون والقوانين والتشريعات الوضعية للدول، وعملوا على حمايته بشتى الطرق, ومع ظهور عصر الإنترنت والعالم الافتراضي زادت أهمية حماية حق الخصوصية، ويرجع سبب الاهتمام الزائد هذا إلى سهولة انتهاك خصوصية الأشخاص عبر الإنترنت، لاسيما في العصر الحديث مع ظهور مواقع التواصل الاجتماعي كفيس بوك وإنستغرام وتويتر والبريد الإلكتروني وغيرها من الوسائل الإلكترونية التي يستخدمها الأشخاص بشكل يومي ومتكرر. ونظراً لهذا التطور الخطير الذي يهدد الحق في الخصوصية فقد اهتمت المواثيق والمعاهدات والمؤتمرات الدولية والإقليمية بتوفير الحماية لهذا الحق, بالإضافة إلى سن الكثير من الدول لقوانين وتشريعات خاصة تعمل على حماية حق الخصوصية في العالم الافتراضي، وذلك لكثرة الجرائم التي تُرتكب عبر منصات التواصل الاجتماعي من اختراق وسرقة ونشر بدون إذن صاحب الشأن، وغيرها من صور انتهاك خصوصية الأشخاص. حيث قام الباحث بتقسيم البحث إلى فصلين، الأول بتحدث عن حق الخصوصية بشكل عام وكيفية تطوره وخصائصه وصور انتهاك هذا الحق, ثم الفصل الثاني والذي شرحنا فيه الوسائل الدولية والإقليمية والوطنية لحماية حق الخصوصية في العالم الافتراضي, بالإضافة إلى مقارنة هذه الحماية بين التشريع الفلسطيني والإماراتي. وقد توصل الباحث في نهاية بحثه إلى عدد من النتائج والتوصيات وذلك لمعالجة جرائم انتهاك الخصوصية في العالم الافتراضي، أهمها أن المشرع الفلسطيني وفق بقانون العقوبات المعدل والمطبق في قطاع غزة أنه حذا حذو المشرع الاماراتي في حماية حق خصوصية الأفراد عبر مواقع التواصل الاجتماعي رغم أنه يتضمن مصطلحات فضفاضة, وإننا نوصي بإصدار قانون فلسطيني عصري مواكب للتطور التكنولوجي، وذلك لمواجهة الجرائم الإلكترونية والتي تحدث عبر العالم الافتراضي، على أن يتضمن نصوصاً تعمل على حماية الحق في الخصوصية. Abstract The right to privacy in general has received considerable attention since the time of jurisprudence, laws and positive legislation of States and have worked to protect it in various ways. With the advent of the online age and the virtual world, the importance of protecting the right to privacy has increased. This is due to the increased interest in the ease of violating people's privacy online, especially in the modern age and the emergence of social media sites such as Facebook, Instagram, Twitter, email and other electronic means used by people on a daily and frequent basis. In view of this grave development that threatens the right to privacy, international and regional instruments, treaties and conferences are concerned with the protection of this right. In addition, many States have enacted special laws and legislation that protect the right to privacy in the virtual world. The many crimes committed through social media platforms are committed against hacking, theft, unauthorized publication and other images of violation of people's privacy. The researcher divided the research into two chapters. He spoke about the right to privacy in general and how it evolved, its characteristics and images of the violation of this right. Then chapter II, in which we explained international, regional and national means of protecting the right to privacy in the virtual world, in addition to comparing this protection between Palestinian and Emirati legislation. At the end of his research, the researcher reached a number of conclusions and recommendations to address privacy offences in the virtual world, the most important is that the Palestinian legislature in accordance with the amended Penal Code applied in the Gaza Strip he followed the example of the UAE legislator in protecting the right to privacy of individuals on social media sites although it includes loose terminology, We recommend the enactment of a modern Palestinian law in keeping with technological development, In order to counter cybercrime that occurs across the virtual world, It should include provisions protecting the right to privacy.
